There are misconceptions surrounding the meaning of certain terms, such as child “custody” versus child “placement.” More specifically, many people are unaware of the fact that custody does not refer to where a child lives, but which parent has decision-making power regarding the child’s health care, education and general welfare. The term “placement” is traditionally used in Rhode Island to indicate which parent possesses the child and where the child lives.

Another common misconception has to do with the length of the divorce process and the requirements for effectuating an absolute divorce (e.g., pleadings, the process of asset division, tax consequences).
